TERMS & CONDITIONS

TERMS

Application

Application for allotment of apartment should be made on the prescribed from duly signed by the applicant along wimithe Booking money and other necessary documents. The Company THE WILLS HOMES LIMITED reserves the right to accept or reject any application without assigning any reason thereto. On acceptance of an application, THE WILLS HOMES LIMITED will issue an allotment agreement with specific terms and conditions to the Applicant.

Allotment

Until making the lull payment of installment and other charges, the buyer will not be able to transfer the allotment to third party other than the buyer's wife/husband or children without written approval of the company.

Signing of Deed of Agreement

Atter confirmation of allotment, the buyer has to sign the deed of agreement within-30 (thirty) days from the date of making the payment of Ear. Money.

Payments

All Payments of Earnest money, Installments, car park cost, Additional works and other charges shall be made by .k Draft or Pay Order In favor of 'THE WILLS HOMES LIMITED. for which respective receipts will be issued. Bangladeshis residing aboard may remit Payments by TT or DD. Payment of installments and all other charges are to be made on due dates. The company may Issue reminders to the allottee but, notwithstanding the issue of reminders, the alloltee must adhere the schedule of payment to ensure timely completion of construction. Any delay will make the allottee liable to pay charge of 516 per 30 days on that amount of payment delayed. If the payment is delayed for 90 days, the company shall have the right to cancel the allotment without a, notice to the allottee, in such case buyers deposited amount will be refunded after sale out the same apartment to a new buyer. Also an amount of lk 1,00,000.00 (Taka one lac only) will be deducted from the buyers deposited amount for incidental charge.

Registration and Transfer Cost

The company will register a deed of sale in favour of the buyer after receiving the price in full. The buyer shall bear all costs relating to stamp papers and all taxes (such as transfer fee, stamp duly, gain tax, registration fee, VAT, land dev.. Go. taxes 8 others relevant expenses etc.).

Utility Charges

In case of any cancellation of booking of an apartment by a client, the amount deposited will be refunded after selling of that apartment to the new buyer and on deduction of incidental charges of Tk. 1,00,000/- (Taka One Lac) only.

Change in Specifications

Limited changes in the specification, design and/or Layout of the apartments and other facilities may be made by THE WILLS HOMES LIMITED in larger overall interest or due to unavoidable reasons. After taking over of apartrnent or the project, the allottee must consult with THE WILLS HOMES LIMITED prior to undertaking any stnictural or layout changes within the apartment complex. Failuie to do so will be at the sole risk of the allottee.

Owners Common Management

Association Maintenance of all common services and facilities after completion of the project will be done by respective owners co-operative society, which will be formed in due time. Each apartment owner will deposit Tk. 30,000/- (Take Thirty thousand) only to the company for the reserve fund shall be used tor maintenance and repair of common facilities of the project Each Apartment owners shall pay the monthly establishment expenses (service charge) included electric charge tor lift, lighting the common area, water pump, guard, cleaner etc. Proportionately as fixed by the siciety.

Possession

The possessions of itihe apIttreent will be handed over to the purchaser after completions of installments and other charges. Until and unless the dues are not paid, possession of the apartment will not be handed over to the allottee.

Company Rights & Allegations

The Company has the right to accept or reject arty application for allotment. It also reserves the right to make changes in both Architectural and Structural design of the project if necessary. Limited change can be made in specifications for overall interest of the project. Force measure, strikes, political disturbances, economic depression and changes in the fiscal/commercial policy of the state or any act of God beyond the control of the Company may affect the completion time of the consttuction of the project. In such cases. the Company reserves the right to reschedule the constiuction time.
